1Acceptance
MiEspacio is operated by Bohdan Hordiychuk, a sole proprietor (autónomo) registered in Spain. Communication languages: Spanish, English.These Terms of Use ("Terms") govern your access to and use of the website miespacio.app, mobile applications and related services ("Platform"). By using the Platform you confirm that you have read, understood and agree to comply with these Terms. If you do not agree, you must stop using it.We reserve the right to update these Terms. Material changes will be notified at least 15 days in advance by email or by a prominent notice on the Platform; continued use after that date constitutes acceptance.
2Marketplace
MiEspacio is a marketplace platform connecting consumers with independent businesses ("Businesses" or "Traders") and allowing them to discover, compare and book services. For the purposes of Regulation (EU) 2022/2065 (DSA), MiEspacio is an "online platform allowing consumers to conclude distance contracts with traders" (Arts. 30-32 DSA) and is subject to the corresponding additional obligations.Payment flow — critical point:Use of the Platform is free for consumers. We do not charge commissions for booking.Booking or service payments are settled directly between the consumer and the payment processor contracted by the Business itself (Redsys, Stripe or others). MiEspacio is not a party to the collection, does not receive the money, does not appear on the consumer's bank statement and is not a party to the service contract.MiEspacio's revenue source is the B2B SaaS subscription paid by Businesses and billed by Lemon Squeezy as Merchant of Record (Section 6 bis).MiEspacio may add, modify or discontinue features; material changes for subscribed Businesses will be notified with reasonable advance notice.
3Registration
To access certain features you must create an account. You agree to provide accurate and up-to-date information, maintain password confidentiality, not share access and immediately notify any unauthorised use. Minimum age: 14 years (Art. 7 LOPDGDD); for Businesses, the holder must have legal capacity to contract. We may suspend or delete accounts that breach these Terms.
4Usage Rules
It is prohibited to: use the Platform for unlawful purposes; publish false, offensive or harmful information; infringe third-party rights; attempt unauthorised access or circumvent security measures; use bots or scrapers without written consent; send spam; create multiple accounts to bypass restrictions; upload malicious software. Breach may result in suspension or closure of the account and, where applicable, notification to authorities.
5User Content
You retain all rights to the content you post (reviews, comments, images). By posting it, you grant MiEspacio a non-exclusive, royalty-free, worldwide licence to host, display and distribute it on the Platform. You are responsible for the legality and accuracy of the content. MiEspacio may remove it under the DSA moderation rules (Section 13).
6Part A · Consumers
This Section 6 addresses individuals using the Platform as consumers within the meaning of Royal Legislative Decree 1/2007 (LGDCU) and equivalent legislation of their Member State.Free of charge: use of the Platform is free. MiEspacio does not charge consumers any amount for searching businesses, communicating with them, booking services or posting reviews.MiEspacio acts as a marketplace intermediary: it facilitates discovery, scheduling and communication, but does not deliver the booked service. The service (haircut, veterinary visit, restaurant meal, etc.) is delivered exclusively by the chosen business ("Business" or "Trader"), which acts as an independent trader and is the sole counterparty of the consumer in the service contract.Booking payment — direct to the Business: payment is collected by the Business itself via its contracted payment gateway (Redsys, Stripe or others). MiEspacio is not a party to the payment transaction, does not process it, does not receive card data, does not custody it and does not appear on your bank statement. Refunds, cancellations, no-shows and additional charges are governed by each Business's policy as published on its profile and by the LGDCU vis-à-vis the Business.LGDCU rights against the Business: you retain in full your consumer rights against the service provider (pre-contractual information Art. 60 LGDCU, statutory warranties, conformity, liability for defective services). MiEspacio fulfils its transparency obligation (Art. 90 LGDCU + Art. 31 DSA) by providing clear and verifiable information about the Trader.14-day right of withdrawal: the period of Art. 102 LGDCU runs against the service contract concluded with the Business, not against the use of MiEspacio's Platform (which is free and does not constitute a paid distance contract with MiEspacio). The exceptions of Art. 103 LGDCU may be invoked by the Business (e.g. service already performed with your consent). MiEspacio will facilitate communication with the Business as needed.Reviews: only consumers with a confirmed booking can post a review. More detail on the Safety page.DSA notice mechanism: for allegedly illegal content on any profile, the "Report" link is available on each item or you may write to legal@miespacio.app (Section 13).Out-of-court resolution: you may use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr and the consumer arbitration boards competent against the Business.Governing law and forum (EU consumer): notwithstanding the rest of these Terms, disputes between a consumer with habitual residence in an EU Member State and MiEspacio are governed by the mandatory consumer-protection rules of the consumer's country of residence (Regulation (EC) 593/2008 "Rome I", Art. 6) and the courts of the consumer's domicile have jurisdiction (Regulation (EU) 1215/2012, Arts. 17-19).
7Part B · Businesses (B2B)
This Section 6 bis addresses exclusively the natural or legal persons using the Platform to offer their services to consumers ("Businesses" or "Traders"). For them, MiEspacio provides a B2B SaaS service (CRM, calendar, public profile, analytics, team management).Subscription and billing via Lemon Squeezy (Merchant of Record) — for this B2B line only: paid plans are contracted through Lemon Squeezy (Lemon Squeezy, LLC, 251 Little Falls Drive, Wilmington, Delaware 19808, USA), which acts as Merchant of Record only for the billing of Businesses' SaaS subscriptions. Lemon Squeezy issues the invoice, collects applicable VAT / sales tax, manages refunds and disputes under its own Terms and Privacy Policy. Lemon Squeezy does not intervene in payments made by consumers to Businesses for bookings.Plans: monthly or annual, with free trial where applicable. Prices are shown net of VAT where the operation allows; Lemon Squeezy adds the relevant tax for the Business's country.Cancellation: the Business may cancel renewal at any time from its panel; cancellation takes effect at the end of the current billing period. The consumed period is not refunded except as provided by Lemon Squeezy and applicable law.Trader KYC (DSA Art. 30): the Business must provide and keep updated legal name or full name, tax identifier, address, identification of the legal representative and, where required, a declaration of compliance with applicable law. MiEspacio may request additional documentation and suspend the account pending verification. We will retain this information for the duration of the relationship and 6 months thereafter.Traceability and compliance-by-design (DSA Arts. 31-32): MiEspacio implements interfaces enabling the Business to comply with its pre-contractual information duties to the consumer (total price, identity, contact details, cancellation policy). The Business must complete those fields truthfully.Acceptable Use Policy (AUP): the Business undertakes to publish only services lawful in its jurisdiction, with accurate descriptions and transparent prices; it shall not offer prohibited services, age-restricted products without verification, or any offering infringing local rules.Business's own payment gateway: the Business is solely responsible for enabling and operating its processor (Redsys, Stripe, etc.), for PCI-DSS compliance, refunds and any consumer disputes. MiEspacio does not participate in this flow and assumes no responsibility for amounts the Business charges consumers.Liability: the Business assumes sole responsibility for service delivery, published information, customer service, statutory and commercial warranties and compliance with applicable sector regulation. It will hold MiEspacio harmless against claims arising from its breach.Suspension / termination (DSA Arts. 23 and 17): MiEspacio may suspend or terminate Business access in case of repeated breach, fraud, manifestly illegal content, authority order or non-payment. The motivated decision and available remedies will be notified (Section 13).B2B right of withdrawal: the regime of Art. 102 LGDCU does not apply to the B2B contract between MiEspacio and the Business (relationship between traders). Refunds and policies are governed by Lemon Squeezy's terms and by Spanish law applicable to B2B.Governing law and forum (B2B): disputes between MiEspacio and the Business are governed by Spanish law, with express submission to the courts of Alicante (Spain), save for any mandatory rule to the contrary.
8Intellectual Property
The Platform, including its design, code, logos, trademarks, text, graphics and other content, is the intellectual property of MiEspacio and is protected by applicable copyright and intellectual-property laws. Without our prior written consent, it is prohibited to copy, modify or distribute Platform materials, use MiEspacio logos or trademarks, create derivative works or reverse-engineer the software.
9Liability
Without prejudice to mandatory consumer rights, the Platform is provided "as is" without warranties of any kind. MiEspacio does not guarantee uninterrupted or error-free operation or the accuracy of information posted by Businesses or users. MiEspacio is not responsible for the delivery of the booked service or its associated payment, which are the sole responsibility of the Business and its payment processor. MiEspacio's liability towards consumers shall be limited to direct damages duly evidenced; towards Businesses, it is limited to the subscription amount paid by the Business in the preceding 12 months.
10Privacy
Data processing is governed by the Privacy Policy, which covers MiEspacio as the controller (Spanish autónomo), Lemon Squeezy as independent controller for B2B billing and the Businesses as independent controllers for the data they receive after a booking.
11Termination
You may stop using the Platform and delete your account at any time via Settings → Account. MiEspacio may suspend or terminate access for breach of these Terms, fraudulent or illegal activity, prolonged inactivity (>24 months) or non-payment of the subscription. Termination does not affect obligations arising before that date.
12Governing Law
These Terms are governed by Spanish law. Without prejudice to the specific rules for consumers (Section 6) and Businesses (Section 6 bis):Consumers with habitual residence in the EU: the mandatory rules of the consumer's country of residence apply (Regulation (EC) 593/2008 "Rome I", Art. 6) and the courts of the consumer's domicile have jurisdiction (Regulation (EU) 1215/2012, Arts. 17-19).Businesses and other B2B relationships: express submission to the courts of Alicante (Spain), save for any mandatory rule to the contrary.Out-of-court resolution: consumers may use the EU ODR platform (ec.europa.eu/consumers/odr) and the Consumer Arbitration Boards. DSA disputes may be submitted to a body certified by the Digital Services Coordinator (in Spain, the CNMC).

14Moderation (DSA)
As an online platform subject to Regulation (EU) 2022/2065 (DSA) under the enhanced regime for marketplaces (Arts. 30-32):Trader traceability (Art. 30 DSA — KYC): before allowing a Business to be listed, we collect and verify the required identifying details (name, address, contact, commercial identifier, self-certification of compliance). We retain this information for the duration of the relationship and a reasonable period thereafter.Compliance-by-design (Art. 31 DSA): the Platform allows traders to provide the mandatory pre-contractual information to consumers.Information to affected consumers (Art. 32 DSA): if we become aware of an illegal product or service offered by a trader, we will notify without undue delay the consumers who acquired it in the preceding six months.Notice of illegal content (Art. 16 DSA): any person may flag allegedly illegal content via the "Report" link or by writing to legal@miespacio.app. We will acknowledge receipt and act without undue delay.Statement of reasons (Art. 17 DSA): when we remove content, restrict its visibility or suspend/terminate an account, we will provide a clear and specific statement of reasons.Internal complaint-handling system (Art. 20 DSA): for six months you have access to a free, effective mechanism to challenge our moderation decisions.Out-of-court dispute settlement (Art. 21 DSA): you may submit the dispute to a body certified by the Digital Services Coordinator (in Spain, the CNMC).Trusted flaggers (Art. 22 DSA): notices from entities recognised as trusted flaggers are given priority.Transparent advertising (Arts. 26 and 28 DSA): advertising is identified as such and we do not profile minors. We do not use special-category data (Art. 9 GDPR) to personalise ads.Single point of contact (Art. 11 DSA): authorities, Digital Services Coordinators and the European Commission may contact legal@miespacio.app.Suspensions and restrictions applied are documented and kept for 6 months for audit purposes.
